This Lecture will be delivered by Professor Nicole Moreham, as part of the Current Legal Problems Lecture Series 2026-27. Is the unwanted dissemination of a deepfake a breach of privacy? This lecture will examine that question in the context of the English and Welsh tort of misuse of private information tort. It asks whether and how the privacy tort can be used to compensate the harm caused by deepfake images, looking first at when the reasonable expectation of privacy test can be relied on to protect against the unwanted dissemination of false information. Moreham will explain how deepfakes fit into an already-established category of privacy protection for false information which would have been private if it were true. But, she will explain, the harm in false privacy situations is different from that suffered when the information is true. The lecture will examine the nature of harm in deepfake cases, arguing that putting in issue an intimate aspect of a person's private life is a secondary privacy harm which deserves compensation in the privacy tort.
